These terms apply when you use justcamellia.com or buy from Just Camellia. Please read them before ordering. Nothing in these terms affects the legal rights of a consumer.
1. About us
Just Camellia is a trading brand owned and operated by Netzalive Group Ltd, a company registered in England and Wales under company number 15943003. Our registered office and contact details appear at the end of these terms.
2. Who may order
You must be at least 18 years old and legally capable of entering a contract to place an order. You are responsible for ensuring that the information you give us is complete and accurate.
3. Products and website information
We take reasonable care to describe and display products accurately. Natural products may vary in colour, size, cut, aroma and appearance. Packaging may differ from website images. Measurements and colours are approximate, and your screen may display colours differently.
Always read the label, ingredients, allergen information, warnings and instructions supplied with a product. Website content is not medical advice; please also read our Legal Disclaimer.
4. Ordering and the contract
When you submit an order, you are offering to buy the products in your basket. An automated acknowledgement confirms receipt of your order but does not mean we have accepted it. A binding contract is formed when we send confirmation that the order has been accepted or dispatched, whichever occurs first.
We may decline or cancel an order before acceptance, for example because an item is unavailable, payment cannot be authorised, an obvious price or description error has occurred, delivery restrictions apply, or we reasonably suspect fraud or misuse. If we have taken payment, we will refund the affected amount.
5. Prices, payment and promotions
Prices are shown in pounds sterling and include VAT where applicable. Delivery charges and any other applicable costs are shown before you place the order. We may change prices at any time, but this will not normally affect an accepted order.
Payment is taken through the payment methods shown at checkout. You confirm that you are authorised to use the selected method. Promotional codes are subject to their stated conditions, cannot normally be exchanged for cash or combined, and may be withdrawn where misuse or an error is identified.
6. Availability and substitutions
Products are subject to availability. If an item becomes unavailable after ordering, we will contact you and offer an appropriate alternative where suitable or refund the unavailable item. We will not substitute a product without your agreement where the substitution would materially differ or affect ingredients or allergens.
7. Delivery
Delivery options, territories, charges and estimates are shown at checkout. Delivery dates are estimates unless we expressly agree a guaranteed date. We are not responsible for delay caused by events outside our reasonable control, but we will contact you and take reasonable steps to minimise the effect.
You are responsible for providing a complete, secure delivery address and for any redelivery cost caused by an incorrect address or failure to receive the parcel, except where we are at fault. Risk passes to a consumer when the goods come into their physical possession or that of a person they nominate. Ownership passes when we receive full payment.
8. Cancellation, returns and faulty goods
Your cancellation and return rights, exclusions for certain goods, refund timings and the process for faulty or damaged items are explained in our Refund & Returns Policy, which forms part of these terms. Your statutory rights under the Consumer Rights Act 2015 and other applicable consumer law are not affected.
9. Product use and safety
You must store, prepare and use products in accordance with the label and supplied instructions, including best-before or use-by information. Check ingredients and allergen information before use. Do not use a product if its seal is unexpectedly broken, it appears contaminated or unsafe, or you have been advised not to consume an ingredient.
10. Website accounts
If you create an account, keep your login credentials confidential and tell us promptly if you suspect unauthorised use. We may suspend or close an account where reasonably necessary for security, legal compliance or serious misuse. You may ask us to close your account, subject to our need to retain records required by law.
11. Acceptable use
You must not misuse the website, attempt unauthorised access, introduce malicious code, scrape or copy content at scale, interfere with operation, use the site unlawfully, submit false reviews, or infringe another person’s rights.
12. Intellectual property
The website and its text, branding, graphics, photographs, recipes, layout and other original content are owned by or licensed to Netzalive Group Ltd and protected by intellectual-property law. You may view and print reasonable extracts for personal, non-commercial use. No other copying, adaptation, distribution or commercial use is permitted without prior written consent.
If you submit a review, image or other content, you confirm that you have the right to do so and grant us a non-exclusive, worldwide, royalty-free licence to display and use it in connection with our business and promotion, subject to applicable privacy law. We may remove unlawful, misleading or inappropriate content.
13. Third-party services and links
The website may contain links to or functionality provided by third parties. Their terms and privacy policies may apply. We are not responsible for third-party sites or services we do not control.
14. Our responsibility to consumers
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses where you bought as a consumer.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory consumer rights.
15. Business customers
If you purchase wholly or mainly for business purposes, you confirm that you have authority to bind that business. To the fullest extent permitted by law, we will not be liable for loss of profit, revenue, business, anticipated savings, goodwill or indirect or consequential loss. Any separate wholesale or business terms agreed in writing will take priority where they conflict with these terms.
16. Privacy
We use personal information as described in our Privacy Policy. Our use of cookies is explained through our cookie controls and any Cookie Policy displayed on the website.
17. Changes to these terms
We may update these terms from time to time. The terms in force when your order is accepted will apply to that purchase, unless a change is required by law or you agree otherwise.
18. General
If any provision is found unlawful or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right does not waive it. You may not transfer your rights or obligations under a contract without our written consent; we may transfer ours where this does not reduce your rights. No person other than you and us has a right to enforce these terms.
19. Governing law and disputes
These terms and our contract are governed by English law. If you are a consumer resident elsewhere in the United Kingdom, you retain the benefit of any mandatory protections of your home jurisdiction and may bring proceedings in the courts applicable to where you live. We encourage you to contact us first so we can try to resolve any complaint.
